The Epilepsy Foundation of Metropolitan New York Data Breach Investigation

Turke & Strauss LLP, a leading data breach law firm, is investigating The Epilepsy Institute, which does business as The Epilepsy Foundation of Metropolitan New York (“EFMNY”) regarding its recent data breach. The EFMNY data breach involved sensitive personal identifiable information and protected health information belonging to an undetermined number of individuals.

EFMNY is a non-profit organization combining epilepsy education, awareness, and advocacy with individualized services such as counseling and vocational supports.2 Since its founding in 1967, thousands of people with epilepsy and their families have received information or have benefited from the comprehensive social and educational services offered by the EFMNY.2 Staffed with professionals from the medical, social work, vocational counseling and psychological professions, the EFMNY provides a wide variety of services and supports to persons with epilepsy, their families and the community.2 Headquartered in New York, New York, EMFNY is a regional affiliate of the Epilepsy Foundation of America, which has nearly 50 local organizations throughout the United States.

WHAT HAPPENED?

Recently, EFMNY discovered that it had experienced a data breach in which sensitive personal identifiable information and protected health information in its systems may have been accessed and acquired. Through its investigation, EFMNY determined that an unauthorized actor may have accessed this sensitive information on or about November 8, 2023. As a result, EFMNY began notifying individuals whose information may have been impacted. The type of information potentially exposed includes:

  • Name
  • Social Security number
  • Date of birth
  • Driver’s license or government ID number
  • Medical information
  • Health insurance information
