About Southwest Airlines Rapid Rewards:
Southwest Airlines is major American airline based in Dallas, Texas. In June of 1987, Southwest launched it loyalty program, Rapid Rewards (formerly known as The Company Club). The Rapid Rewards program provides enrolled travelers points based on the cost of purchased tickets.
We believe Southwest Airlines Rapid Rewards dedicated telephone line (1-800-445-5764 only) may be illegally recording consumer telephone calls without the consent of its consumers. Calls made to California consumers or made by California consumers may be protected under California’s Invasion of Privacy Act (“CIPA”). CIPA prohibits various forms of intentional recording or eavesdropping without the consent of all parties to the conversation. Specifically, § 632(a) imposes liability on:
“Every person who intentionally and without the consent of all parties to a confidential communication, by means of any electronic amplifying or recording device, eavesdrops upon or records the confidential communication . . .”
Under CIPA, businesses are not prohibited from recording calls, instead they are only required to disclose or inform the consumer that the call is being recorded.
