About Shinola:

Shinola is a Detroit, Michigan-based luxury consumer brand. It produces watches, bicycles, journals and leather goods, among other products. Shinola is part of Bedrock Brands, a Dallas, Texas based investment group.

Investigation overview:

We believe Shinola may be illegally recording consumer telephone calls without the consent of its consumers. Calls made to California consumers or made by California consumers may be protected under California’s Invasion of Privacy Act (“CIPA”). CIPA prohibits various forms of intentional recording or eavesdropping without the consent of all parties to the conversation.  Specifically, § 632(a) imposes liability on:

“Every person who intentionally and without the consent of all parties to a confidential communication, by means of any electronic amplifying or recording device, eavesdrops upon or records the confidential communication . . .”

Under CIPA, businesses are not prohibited from recording calls, instead they are only required to disclose or inform the consumer that the call is being recorded.

Damages:

If you’re a California resident and you believe a telephone call has been recorded without your permission, you may be entitled to $5,000 per violation or three times the amount of damages suffered.
