Alex Phillips

Attorney

Overview

I litigate commercial, class action, and employment cases in trial and appellate proceedings across the country. Clients and co-counsel trust me to protect their best interest through critical case phases, including deposing key witnesses, briefing dispositive motions, negotiating settlements, and guiding clients through the litigation process. As a result, I feel comfortable with new or complex issues and leaning in to challenging cases.

In any case, my goal is to take my client’s legal position as it is and improve it several steps, developing weak cases into good ones, good ones to great, and great to excellent. To do so, I define my client’s goals early and shape the litigation around them, guiding the client through the process with straightforward advice. Through high-level planning and detailed execution, I routinely deliver favorable outcomes for clients.

Experience

Commercial Litigation

I have experience representing business clients in contract disputes, under the Uniform Commercial Code, and Wisconsin’s professional services regulations. I understand that a “win” in a business dispute can range from a pre-litigation resolution that preserves the business relationship to winning a favorable verdict at trial. As a result, I consider my clients’ business goals first and then pursue strategies that serve those goals.

Class Action

I litigate data breach, Telephone Consumer Protection Act (“TCPA”), and defective products cases in our firm’s class action practice group. I have experience drafting complaints, opposing motions to dismiss, briefing class certification, drafting mediation statements for multi-million dollar settlements, and resolving discovery disputes. My compelling writing and advocacy assists in leading our clients’ cases to favorable outcomes.

Employment

I represent employers and employees in discrimination, contract, and wage disputes. I have litigated multiple discrimination cases through mediation at the Equal Employment Opportunity Commission, wage disputes in Wisconsin state court, and disability discrimination cases in federal court. I understand the personal nature that comes with employment cases, including the harmful effects it can have on businesses and careers. As a result, I prioritize my clients’ desired outcome, whether that is a fair, early settlement or preparing their case for trial.

Notable Successes

  • Briefed class certification in a TCPA class action covering thousands of consumers, with the Court granting the motion and certifying the class;
  • Negotiated several six-figure settlements for employees in discrimination and wage disputes;
  • Successfully challenged a bankruptcy discharge claim by arguing the claimant embezzled company funds, preserving our client’s half-million dollar claim in a separate lawsuit;
  • Drafted several key oppositions to motions to dismiss in consumer products and TCPA cases; and
  • Defeated a dispositive motion on behalf of an Olympic athlete, leading to settlement on her misappropriation of identity claim.
